Privacy Policy

Most AnyTour data stays on your device. We do not sell your personal information, store your location, or upload your raw family history file. Only pack purchasers and partner-linked users have a server-side account, used to preserve and track their access.

1. Introduction

Caywood Creative LLC ("we," "our," or "us") owns and operates the AnyTour mobile application (the "App"). This Privacy Policy explains how we collect, use, and protect your information when you use AnyTour. By downloading, installing, or using AnyTour, you expressly consent to the collection and use of your information as described in this Privacy Policy. If you do not agree to these practices, please do not use the App.

1.1 Geographic Scope

AnyTour is currently available for download and use only in the United States and Canada. This Privacy Policy is designed to comply with the privacy laws of both jurisdictions. If you are accessing AnyTour from a location outside the United States or Canada, you are not authorized to use this App.

2. Information We Collect

2.1 Location Data

AnyTour requests access to your device's location while the app is in use. Your location is used solely to identify what is around you and generate a personalized tour narration. We do not store your location data on our servers. Location data is transmitted to our tour generation service only at the moment a tour is requested, and is not retained after the tour is generated.

2.2 Microphone and Speech Recognition

If you use the voice question feature, AnyTour accesses your microphone to capture your spoken question. Speech recognition is processed on-device using Apple's Speech framework. Voice audio is not transmitted to our servers or stored.

2.3 Purchase and Subscription Information

Subscription purchases are processed entirely through Apple's App Store. We receive confirmation of your subscription status from Apple but do not have access to your payment information. Consumable pack purchases (Single Tour, Weekend Pack) are also processed through Apple's App Store.

2.4 Tour History and Saved Places

Tours you have taken and places you have saved are stored locally on your device. This data is not transmitted to or stored on our servers.

2.5 Genealogy and Heritage Data

If you choose to use the Heritage feature, AnyTour allows you to import a GEDCOM file. Your GEDCOM file is parsed entirely on your device. The raw family history data is never transmitted to our servers, never uploaded to any third-party service, and never leaves your device. Parsed ancestor information is used solely to personalize your tour narration and is stored only in your device's local database. You may remove your heritage data at any time.

2.6 Tour Narration Requests

When you start a tour, your location coordinates, tour preferences, and a summary of relevant ancestor context (if Heritage is active) are transmitted to our AI narration service (powered by Anthropic's Claude) via a secure Cloudflare proxy server. This request is not retained after the tour is generated.

2.7 Voice Narration and ElevenLabs

Tour narration audio is generated via ElevenLabs text-to-speech services. The text content of your tour narration, which may include location details and general ancestor context, is transmitted to ElevenLabs and governed by ElevenLabs' independent privacy policy. Raw GEDCOM data is never sent to ElevenLabs. If you prefer not to transmit content to ElevenLabs, you may use AnyTour in Text mode.

2.8 Account Information (for Consumable Pack Purchases and Partner-Linked Users)

If you purchase a consumable pack (Single Tour, Weekend Pack) or use AnyTour through a partner-linked account, AnyTour creates an account linked to your Apple ID via Sign in with Apple. In this case only, we store the following server-side:

  • Your Apple per-app user identifier (a stable, unique identifier assigned by Apple for your AnyTour account)
  • The product(s) you have purchased
  • Apple App Store transaction ID(s) associated with your purchase(s)
  • The narration minutes granted to your account and the minutes you have used

This server-side data is required because Apple does not restore one-time consumable purchases on app reinstall the way it restores subscriptions. A server-side record ensures you do not lose access to a purchased pack if you reinstall AnyTour.

We do not store the following on our servers:

  • Your payment information (handled entirely by Apple)
  • Your GEDCOM or genealogy data
  • Your tour history, saved places, or tour content
  • Your location data
  • Any data from regular Free, Explorer, or Heritage tier subscriptions

For subscribers on Free, Explorer, or Heritage tier subscriptions (no consumable pack purchases and no partner account): You have no account with us. All data remains stored locally on your device, exactly as described above. This policy has not changed.

2.9 AI Model Training

Your personal data, location, tour requests, and genealogy data are not used to train AI models.

3. Your Consent

AnyTour collects sensitive data including location information. For data categories requiring explicit consent under applicable privacy law:

  • Location data is collected only after you actively grant permission through your device's OS permission dialog.
  • Microphone access is collected only after you actively grant permission through your device's OS permission dialog.
  • During onboarding, users are presented with a clear acknowledgment checkbox requiring active confirmation of consent to this Privacy Policy before proceeding.
  • Heritage data import requires your active participation: you must export a GEDCOM file and manually import it into AnyTour.
  • Continued use of the App constitutes your ongoing consent to the data practices described in this policy.
4. Data Sharing

We do not sell, trade, share, or rent your personal information to third parties. Your data is yours, and we maintain strict policies against monetization of user information.

The following service providers process data as part of delivering AnyTour's features, each under their own independent privacy agreements:

  • Anthropic — AI tour narration generation
  • ElevenLabs — Voice narration generation
  • Cloudflare — Secure API proxy
  • Apple — Subscription processing, consumable pack processing, on-device speech recognition, and account verification via Sign in with Apple
  • Apple App Store Server API — For consumable pack purchases only, we verify your purchase with Apple's server-to-server API to validate and sync your narration minute balance

By using AnyTour, you acknowledge and consent to data transmission to these services. Your use of these services is governed by their independent privacy policies and terms of service.

Genealogy services (Ancestry, FamilySearch, MyHeritage, 23andMe) are not integrated via API. Users export GEDCOM files directly and import them locally. We have no data-sharing relationship with these platforms. Caywood Creative LLC expressly disclaims all liability for the privacy practices, data security standards, or data incidents of any third-party service.

5. Data Retention

AnyTour does not maintain a server-side database of user data for most users. All personal data is stored locally on your device and is deleted when you delete the app.

For users who have purchased a consumable pack or joined via a partner account: Your account identifier, purchase record, transaction ID, and minute balance are retained server-side as long as your account is active. You may request deletion of this data by contacting [email protected], at which point your remaining balance cannot be recovered (as it is tied to the deleted account).

6. Children's Privacy

AnyTour is not directed at children under the age of 13. During onboarding, users are required to confirm they are 13 years of age or older before accessing the App.

United States Compliance: We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13.

Canada Compliance: We comply with Canadian privacy legislation regarding children and youth. The age of digital consent varies by province (13 in most provinces, 16 in Ontario). Users must confirm they meet their province's applicable age of digital consent before accessing the App.

7. Security

We implement industry-standard security measures including encrypted HTTPS transmission for all data sent between the app and our services. Your API requests are routed through a secure Cloudflare proxy that prevents direct exposure of service credentials. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Your Rights

United States: Depending on your state of residence, you may have rights under applicable state privacy laws to access, delete, or correct your data. For consumable pack account holders, you may request deletion of your account data by contacting [email protected].

Canada: Under PIPEDA and applicable provincial privacy laws, you have the right to access, correct, or delete your personal data. For account holders, contact [email protected].

Because we store most data locally on your device, most data rights can be exercised by deleting the app or removing your heritage data from within the app.

9. Changes to This Policy

We may update this Privacy Policy from time to time. For material changes, including changes to what data we collect, how we use it, who we share it with, or our server-side data practices, we will provide advance notice through in-app notification and/or email at least 7 days before the changes take effect.

10. Arbitration and Class Action Waiver

10.1 Mandatory Arbitration

Any and all disputes, claims, or controversies arising out of or relating to this Privacy Policy or any services provided shall be resolved exclusively by binding individual arbitration administered by JAMS or AAA under their respective Consumer Arbitration Rules. The arbitration shall be conducted in the county where you reside or via videoconference. Each party shall bear its own attorney fees and costs; arbitrator fees will be split equally.

10.2 Class Action Waiver

You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action. You waive your right to participate in any class action against Caywood Creative LLC.

10.3 Exceptions to Arbitration

The following disputes are not subject to arbitration: (a) claims for injunctive relief to prevent intellectual property infringement, (b) small claims court disputes, and (c) disputes over Apple's payment processing.

11. Governing Law

This Privacy Policy is governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. For users residing in Canada, this Privacy Policy is also governed by the applicable federal privacy laws of Canada (PIPEDA) and the privacy laws of your province of residence.
